WEDDING PHOTOGRAPHY

TERMS & CONDITIONS

These terms apply to Weddings, Garden Parties, Real Estate and On-Location Portraiture, referred to as "Events" within this document.

With regard to this document the terms we, us, our and ourselves refers to Robbie Knox Photography. The terms you, your and yourselves refers to the persons specified as Customers.

Copyright.

The copyright Designs and Patents Acts assign the copyright of the images to us.

License, Coverage and Reproduction.

Photographs taken during the course of the "event" will be at our discretion although every effort will be made to comply with your requirements. We shall be granted artistic license in relation to the poses photographed and the locations used. Our judgement regarding these matters shall be deemed correct. We shall endeavour to photograph all individuals as requested but accept no responsibility if not all your requirements are met in this regard. For a booking involving a church ceremony, or at certain venues, our movements are sometimes restricted by the official in charge. The position from which we cover the ceremony may not be our choice and therefore we cannot accept responsibility for an obstructed view. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, we will not be responsible for photographs that are not produced due to technical failure.

Prices.

All goods and services specified on the booking form are supplied at the prices ruling on the date of booking. All goods and services not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.

Booking Fee.

The non-refundable booking fee is to the secure your event date in our diary and no other bookings will be taken for that date. If our contract is cancelled, we would lose the opportunity to deliver our services on the specified date and thus get paid the full price. Our booking fee represents 25% (or less) of the total cost of a typical wedding or other event This percentage is deemed a reasonable estimate of our actual loss if you were to cancel before the final six-month period.

Payments.

A booking fee of £200 will confirm your reservation for the "event" (except for Studio Portraiture), as well as full acceptance of the terms and conditions as published. The booking fee will be deducted from the cost of your chosen package (as detailed when booking) when calculating the final balance due. Payment in full of the final balance will be due on the first day of the third month prior to the "event" date. Payment for a pre-wedding shoot (PWS), if applicable, will be due one calendar month before the agreed date of the PWS. Additional goods ordered must be paid for in full at the time of ordering. Titles to all goods remains with us until paid for in full.

Unforeseen Circumstances.

We will arrange for a replacement photographer if we are unable to attend on the "event" date due to unforeseen circumstances or any cause beyond our reasonable control e.g., sudden illness, injury, victim of crime, flooding etc. In the event of cancellation by ourselves, or in the unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.

Ownership.

We retain copyright over all our photographs and all computer files remain our property. We will supply you with a copy of our professionally edited photographs that you have chosen for your Event Album (if applicable), these are for your own non-commercial purposes. Other images will also be available for purchase by your family and friends, you will receive a PIN number that you can share to enable online access.

Rescheduling.

If your "Event" needs to be rescheduled for any reason, and subject to our availability on the new date, the remaining balance must be paid in full prior to the transfer.

Cancellation.

Cancellation will only be accepted via email. If you cancel the booking up to six months before the specified "event" date on the booking form, you shall forfeit the booking fee. If you cancel the booking within the final six months prior to the specified "event" date on the booking form, the full balance less the booking fee of £200 becomes due immediately and must be paid within seven working days.

Product Availability.

In the event of a product being no longer available, such as an album, a suitable alternative of similar quality will be offered.

Archive & Six-Month Rule.

We will store the photographs for a maximum of six months from the date of your "event". It is therefore imperative that you download the photographs ASAP once you have received the link and subsequently backup. If your package includes an album, you must also order within this six-month period else the product is forfeit. If you require access to the photographs after the six-month period, then a £50 archive fee is payable to retrieve the images, if indeed they are still available.

On The Day.

We are the only authorised and official photographers for your "event" day. The earliest we begin work on any "event" day is two hours before and the latest shall be 3.00pm. (typically, 5 hours unless otherwise agreed).

Optional Pre-Wedding Shoot with Guest Book.

The pre-wedding shoot (PWS) must take place within ten miles of Barbon, unless otherwise agreed. It is your responsibility to select the required number of photographs for the guest book and notify us in good time (at least two months before the wedding date). If your selection is not received, we will be unable to organise the manufacture of the guest book and the product will be forfeit. We accept no responsibility whatsoever for damage caused to/by the guest book during the wedding day. The guest book is supplied “as is” and all use is at your own risk.

Accidental Damage & Personal Injury.

Although we strive to make each directed photoshoot as safe as possible, we cannot be held responsible for any accidental damage or personal injuries. It is understood that the client undertakes each photoshoot at their own risk.

Album Delivery.

All wedding albums are delivered direct from the manufacturer via courier.
